Terms of Service

1. Acceptance of terms

By creating an account, accessing Photog Flow, or using any feature of the platform, you agree to these Terms of Service. If you’re signing up on behalf of a business or other organization, you represent that you have authority to bind that organization, and references to “you” throughout this document include both you personally and that organization.

2. What Photog Flow is

Photog Flow is a software-as-a-service platform for photography businesses. The service helps you manage leads, projects, client galleries, an inbox, invoices, contracts, scheduling, and related workflow tools from a single dashboard. Features evolve over time; we may add, change, or remove capabilities, and we’ll make a reasonable effort to give notice before retiring anything you depend on.

3. Accounts

You must be at least 18 years old to create a Photog Flow account. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. If you suspect unauthorized access, notify us promptly. We may suspend or terminate accounts that contain inaccurate information or that are used to violate these terms.

4. Subscriptions and payment

Paid subscriptions are processed through Stripe (see the Privacy Policy for the full subprocessor list). Current pricing is shown during signup and on your billing page; we may change pricing for future billing periods with at least 30 days’ notice to the email on file. Fees are billed in advance for each period and are non-refundable except where required by law; if you cancel mid-period, we’ll typically apply a prorated credit to your final invoice. If a payment fails and stays unpaid for 14 days, we may suspend the account until the balance is resolved.

5. Your content

You retain full ownership of everything you upload to or generate within Photog Flow — photographs, client contacts, messages, gallery content, contracts, and invoices. You grant Photog Flow a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display that content solely to operate the service on your behalf. You represent that you have the rights necessary for everything you upload; for portraits of identifiable people, that includes having model releases or other permissions where the law or your own contracts require them.

6. Acceptable use

You agree not to use Photog Flow to store or distribute illegal content, to upload child sexual abuse material (strictly prohibited and reported to the appropriate authorities on detection), to transmit malware, to infringe someone else’s intellectual property, to harass other users, to reverse-engineer the service, or to resell API access without our written consent. We may suspend accounts that violate these rules.

7. Third-party services

Photog Flow relies on third-party providers to operate. Payments run through Stripe; primary database, authentication, and file storage sit on Supabase; transactional email goes through Resend; error monitoring uses Sentry; product analytics uses PostHog; and AI features are powered by Anthropic. Each provider has its own terms and policies, which apply alongside ours when you use the corresponding feature.

8. AI features

Photog Flow includes AI-powered drafting tools (for example, suggested inbox replies) that use Anthropic models. The output is a suggestion for you to review, edit, and decide whether to send. It is not legal, medical, tax, or other professional advice. You are solely responsible for anything you ultimately send to your clients or publish. Anthropic’s processing of data sent through those features is governed by Anthropic’s own terms and privacy policies.

9. Availability and warranty disclaimer

We work to keep Photog Flow available and performant, but we do not offer a service level agreement on starter plans. The service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure against every possible threat.

10. Limitation of liability

To the fullest extent permitted by law, Photog Flow’s aggregate liability for any claim arising out of or relating to these terms or the service is limited to the amounts you paid us in the twelve months immediately preceding the event that gave rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data.

11. Termination

You may cancel your account at any time from your billing settings. We may suspend or terminate accounts that violate these terms, that pose a security risk, or that we are required to close by law. After termination we’ll keep your data in a dormant state for 30 days so you can export it, after which it is scheduled for deletion.

12. Changes to these terms

We may update these terms from time to time. For material changes we’ll email the address on file before the change takes effect; continued use of the service afterward counts as acceptance.

13. Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these terms or the service will be brought in the state or federal courts located in California, and both parties consent to their exclusive jurisdiction.
